Ownership and Operation
The EquiLink app is owned and operated by Mizar & Alcor Inc. a Canadian registered entity. All rights, title, and interest in and to the app, including its content, design, functionality, and underlying technology, are the exclusive property of Mizar & Alcor Inc. By using EquiLink, users acknowledge and agree to this ownership structure and the terms outlined herein.
Acceptance of Terms
By accessing or using EquiLink, you accept and agree to abide by these Terms, our Privacy Policy, and any other policies referenced. If you do not agree to these Terms, please discontinue your use of EquiLink.
Eligibility
EquiLink is intended for individuals over 4 years of age. By using the EquiLink platform, users affirm that they have the legal capacity to enter into a binding agreement. Minors may access and use EquiLink’s services with the consent and active supervision of a parent or legal guardian. The parent or guardian assumes full responsibility for the minor’s actions on the platform, including any interactions, purchases, or agreements entered into.
Account Registration
● Creating an Account: To use EquiLink, you must create an account, providing accurate and up-to-date information. You are responsible for maintaining the confidentiality of your account and password.
● Account Responsibilities: You are responsible for all activities that occur under your account and agree to notify us immediately of any unauthorized use.
● Business and Product Listings: If you are listing a business, service, event, or digital product, you are responsible for providing accurate, complete, up-to-date and lawful information.
Acceptable Use and User Guidelines
EquiLink is dedicated to fostering a supportive and professional community for users in the equine industry. To maintain a respectful and productive environment, all users must adhere to the following guidelines:
● Permitted Activities: The EquiLink platform may be used to advertise, promote, and sell services, digital products such as eBooks, courses, and training materials, and events such as clinics, seminars, or horse shows which are relevant to the equine industry.
● Prohibited Listings: Job postings and internship opportunities are strictly prohibited on the EquiLink platform and will be removed without notice. Users who repeatedly post prohibited content may face suspension or termination of their accounts.
● Respectful Interaction: Users are expected to interact respectfully with one another and refrain from any harassing, abusive, or offensive language.
● Non-Commercial Use: Users agree not to use EquiLink for any purposes that are commercial outside of the services specifically provided on EquiLink or as otherwise approved by EquiLink.
By using EquiLink, you agree to use EquiLink only for lawful purposes and in accordance with these Terms, and understand that violations may result in restricted access or removal from the platform.
User Responsibilities
To maintain a high-quality experience, users are responsible for ensuring the integrity and accuracy of all content and listings they provide on the platform. By creating an account or submitting any content to EquiLink, you agree to the following responsibilities:
● Accurate Information: You are responsible for providing truthful, accurate, and complete information for all listings and content submitted on the EquiLink platform. EquiLink is not liable for any errors, omissions, or misrepresentations in user-provided content.
● Timely Updates: You agree to promptly update any listing or profile information to reflect changes in availability, pricing, or service details.
● Compliance with Laws: You are responsible for ensuring that all information and services you provide comply with local, state, and federal laws, as well as any industry-specific regulations.
● Adherence to Community Standards: You agree to adhere to community standards and policies that may be updated periodically by EquiLink. These guidelines ensure a supportive, safe, and constructive environment for all users.
You may not:
● Post or distribute harmful, offensive, or fraudulent content
● Use profanity
● Engage in unauthorized use of EquiLink’s trademarks, logos, or other intellectual property
● Interfere with the app's operation, including attempts to breach security measures
● Advertise items, real estate or animals
● Post or distribute copyrighted content that you do not have rights to or permission to use from the current owner. The first infringement will result in a first and final warning, with the following infringement resulting in suspension of the user’s account. EquiLink reserves the right to determine the account suspension duration for each case according to the severity.
Digital Product Listings and Purchases
● Seller Responsibility: If you list digital products, you represent and warrant that you have the right to sell them. All product listings must be accurate and comply with applicable laws.
● Purchases and Refunds: Purchases made through EquiLink are final, except as required by applicable law. Refunds for digital products will be handled on a case-by-case basis and according to our refund policy.
● Commissions on Purchases: EquiLink charges a 5% commission on digital products. This commission, which includes the Stripe Service fee, is deducted from the total sale price before disbursing the remaining balance to the seller. Payments, minus the commission, will be transferred to the seller's registered account within 7 days, and a detailed breakdown of earnings and commissions can be accessed in the seller’s Stripe dashboard. EquiLink reserves the right to update the commission rate with prior notice, and any disputes regarding commissions must be reported within 30 days.
Event Listings and Registrations
● Event Listings Accuracy: You are responsible for ensuring that all event details are accurate, including but not limited to the location, date, time, fees, and any other relevant information. Any changes to event details after listing must be promptly updated to reflect those changes.
● Event Cancellations and Rescheduling: If an event is canceled or rescheduled, the event organizer must notify all registered participants as soon as possible. Please note that EquiLink currently does not provide a refund flow for events, so event organizers must directly communicate with participants regarding cancellations or rescheduling, including any potential refunds or credit options. Event organizers are encouraged to clearly outline their event cancellation and rescheduling procedures within the event details for transparency.
● Event Liability: EquiLink does not accept liability for any accidents, injuries, or damages that may occur during an event. Participants attend events at their own risk. Event organizers are responsible for ensuring that appropriate safety measures are in place, and all necessary insurance requirements are met.
● Attendance Requirements: Some events may have specific requirements such as age, experience level, or special equipment needed. It is the responsibility of the event organizer to clearly outline these requirements in the event listing.
● Refund Policy for Events: EquiLink does not currently facilitate refunds for events. If an event is canceled or rescheduled, it is the responsibility of the event organizer to manage refund requests directly with participants. We recommend event organizers clearly communicate their refund policies within the event listing for transparency.
● Commissions on Bookings: EquiLink charges a 5% commission on in-app event bookings and an upfront listing fee on external bookings. Commissions, which includes the Stripe service fees, are deducted from the total sale price before disbursing the remaining balance to the seller. Payments, minus the commission when applicable, will be transferred to the seller's registered account within 7 days, and a detailed breakdown of earnings and commissions can be accessed in the seller’s Stripe dashboard. EquiLink reserves the right to update the commission rate with prior notice, and any disputes regarding commissions must be reported within 30 days.
Service Listings and Bookings
● Service Listings Accuracy: If you list services, you represent that you have the necessary qualifications, certifications, or licenses to offer the service. All service listings must be clear, accurate, and reflect the actual services provided.
● Service Availability and Pricing: Service providers must ensure that their listed services are available at the prices and locations specified. If there are any changes, the service provider must update the listing immediately.
● Payment Terms for Services: All service payments must be processed through the EquiLink platform. Failure to do so may result in the suspension of the service provider's account. Service providers may not share direct contact information with users before the service is booked. EquiLink provides a chat feature for communication prior to booking. Service providers are responsible for ensuring that all payments are handled via the platform.
● Payments for Users: For one-time services and recurring payments, payments will be processed when the service provider accepts the booking request. For recurring bookings, payments will be debited at the start of each following billing cycle.
● Commission and Fees: EquiLink charges a 5% commission on each service booking, including Stripe service fees. These fees are deducted from the total amount of the booking before payment is disbursed to the service provider.
● Recurring Payments: Businesses may enable recurring payments for services, except for per-session services. Recurring payments will be processed in accordance with the frequency selected by the service provider (e.g., weekly, monthly). For recurring payments, the service provider and users must clearly define the terms (e.g., start date, and amount).
● Payment Payout Schedule:
Hourly Services: Payments for hourly services will be paid out the following Sunday after the service is completed.
Daily and Monthly Services: Payments for daily and monthly services will be paid out on the 1st of each month.
One-Time Payments: One-time payments will be paid out within 7 days of service completion.
● Cancellation or No-Show Policy for Services:
A full refund will be issued if a cancellation is requested at least 48 hours prior to the booked service time.
A 50% refund will be issued if a cancellation request is made 28 to 24 hours prior to the booked service time.
No refund will be issued if the cancellation request is made within 24 hours of the service time.
● Ratings and Reviews: After a service has been completed, users will be able to rate and review the service provider. Both positive and negative feedback should be based on actual experiences and must comply with EquiLink’s review guidelines. Inappropriate or defamatory reviews may be subject to removal.
● Service Provider Responsibility: Service providers must adhere to all applicable laws, regulations, and safety guidelines when offering their services. EquiLink reserves the right to remove any service listing that does not meet these standards or violates our community guidelines.
● Disputes: In the case of disputes between service providers and users, EquiLink will act as an intermediary to assist in finding a resolution. However, EquiLink is not responsible for the outcome and encourages both parties to communicate effectively to resolve any issues.
Opportunity Board Prohibited Listings
The EquiLink Opportunity Board is designed to showcase special opportunities within the equine industry, including but not limited to grants, sponsorships, casting calls, and other unique offers. Job postings, internship listings, and employment opportunities are not allowed. However, businesses can toggle their hiring status on their business profiles, and users can filter for hiring businesses.
All opportunities submitted to the Opportunity Board are reviewed by EquiLink prior to posting to ensure they align with our guidelines. Any listings that do not meet these guidelines may be removed without notice, and users who repeatedly post prohibited listings may face suspension or termination of their accounts.
Intellectual Property Rights
EquiLink respects intellectual property rights and expects users to do the same. The following terms apply to all content and intellectual property on the platform:
● EquiLink Content: All content on EquiLink, including text, graphics, logos, and software, is our property or licensed to us. You may not use, reproduce, or distribute EquiLink’s content without permission.
● User-Generated Content Licence: By submitting content to EquiLink, including business listings, reviews, images, or written materials, you grant EquiLink a non-exclusive, worldwide, royalty-free, and sublicensable licence to use, reproduce, modify, display, and distribute your content on the platform and in promotional materials. This licence ends when you remove your content from the platform.
● User Content Responsibility: Users are solely responsible for ensuring they have the rights to any content they upload to EquiLink and that such content does not infringe on any intellectual property rights of others.
● Copyright Complaints: EquiLink respects the rights of copyright holders, however is not liable for any infringement of copyrighted content by someone without the necessary rights or any damages it may cause. If you believe any content on the platform infringes on your copyright, please contact us at info@equilinkapp.com with details of the alleged infringement.
Disclaimers and Limitation of Liability
EquiLink acts as a directory and information-sharing platform but does not directly control user interactions, listings, or transactions. By using EquiLink, you agree to the following limitations of liability:
● Disclaimers: EquiLink is provided “as is” without warranties of any kind, either express or implied. We do not guarantee the accuracy or reliability of any listings, products, or other content on the app.
● Limitation of Liability: To the maximum extent permitted by law, EquiLink shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your use of the app. This includes loss of profits, data, or other intangible losses.
● No Guarantee of Listings or Content Accuracy: EquiLink does not guarantee the accuracy, completeness, or quality of any listing, service, or content on the platform. EquiLink is not liable for any errors or omissions in user-generated content.
● No Liability for Disputes: EquiLink is not responsible for any disputes between users. Any issues related to services, transactions, or representations made by other users must be resolved between the parties involved.
● Service Interruptions and Errors: EquiLink is not liable for any interruptions, errors, or technical issues that may disrupt access to the platform or cause loss of data. While we strive to maintain a stable platform, EquiLink does not guarantee uninterrupted access.
● Limitations on Damages: To the fullest extent permitted by law, EquiLink disclaims liability for any indirect, incidental, or consequential damages arising from the use or inability to use the platform.
Termination
We may suspend or terminate your access to EquiLink, at our discretion, if you violate these Terms or engage in any activities harmful to EquiLink or its users. Upon termination, any rights and licences granted to you will end. EquiLink reserves the right to suspend or terminate user accounts under the following circumstances:
● Violation of Terms and Conditions: If a user violates any provisions outlined in these Terms and Conditions, including but not limited to prohibited activities, misrepresentation, or abuse of the platform.
● Fraudulent or Malicious Activity: If a user is found engaging in fraudulent, illegal, or harmful activities that compromise the integrity, security, or functionality of the EquiLink platform.
● Inactivity: Accounts that remain inactive for an extended period of time (e.g., 5 years) may be terminated at EquiLink's discretion.
● Request by User: Users may request account termination at any time by contacting customer support at info@equilinkapp.com . Upon termination, any remaining data associated with the account will be handled as per our Privacy Policy.
● Termination Without Cause: EquiLink reserves the right to terminate any account at its sole discretion, with or without notice, for reasons not explicitly listed above.
Effects of Termination:
● Upon termination, the user will lose access to their account and any content or services associated with it.
● EquiLink is not liable for any loss of data, revenue, or opportunity resulting from account termination.
Appeal Process:
● Users whose accounts are terminated may contact EquiLink support to request a review of the decision. EquiLink retains the final authority on reinstating accounts.
Indemnification
You agree to indemnify, defend, and hold harmless EquiLink and its affiliates, officers, directors, and employees from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of EquiLink, your breach of these Terms, or any violation of law or rights of a third party.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Québec, Canada. Any disputes arising from these Terms or your use of EquiLink will be resolved through binding arbitration in Québec, Canada, unless otherwise required by law.
Changes to these Terms
We may update these Terms occasionally to reflect changes in our practices or applicable law. If we make significant changes, we will notify you through EquiLink or by email. Continued use of EquiLink after such changes indicates acceptance of the revised Terms.
