Business Agreement

The terms that apply to businesses and professional accounts using EquiLink.

This Business User Agreement ("Agreement") is a supplement to the EquiLink Terms of Service and applies to users who utilize EquiLink in a business capacity – such as service providers, event organizers, trainers, instructors, equine professionals, brands, or any user who creates a business profile, offers services or events, or subscribes to Business+ or Business Premium on EquiLink. By registering as a business user or claiming/creating a business listing on EquiLink, you ("Business User" or "you") agree to this Agreement. If you do not agree, you must not use the Platform as a business service provider or brand.

1. Eligibility and Account Setup

  • Minimum Age and Authority: Business Users must be 18 years of age or older. By signing up as a provider/organizer or subscribing to a business plan, you represent that you are at least 18. If you are creating a business profile on behalf of a company or organization, you further represent that you have the authority to bind that entity to this Agreement and that entity accepts these terms.
  • Account Types: EquiLink may allow separate business profiles or the conversion of a personal account into a business account. Ensure your business profile accurately reflects your business name and details. Do not pretend to be a different business or misclassify your category. Each physical business or distinct brand should have one account (with multiple authorized users if needed – contact us if you need multi-user management).
  • Verification: Upon creating a business listing, EquiLink may require you to verify your identity and certain details about your business. This could include providing a government-issued ID, business license, certification documents (e.g., a riding instructor certification or veterinary license if relevant), proof of ownership of a facility, or other credentials. We may also verify contact information (sending a code to your phone or email). You agree to provide accurate, truthful information and to promptly supply any documentation we reasonably request. EquiLink reserves the right to reject or remove a business listing if we cannot verify the claimed identity or qualifications, or if we suspect fraud.
  • Claiming Listings: If your business was listed on EquiLink by someone else (for instance, a rider added your stable to the directory), you can "claim" it by going through our verification process to prove you are the owner or an authorized representative. Until claimed, some features (like editing the profile or receiving bookings) may be limited. Once you claim, you become responsible for the content of that listing. Only claim listings that you are rightfully associated with.

2. Business Subscriptions: Business+ and Business Premium

EquiLink offers two primary subscription plans for business users, as described in our Terms of Service and on our website: Business+ and Business Premium. Here are the terms specific to these plans:

Features and Benefits

  • Business+ ($24.99/month or $249.99/year): This plan includes the ability to conduct in-app transactions with a favorable fee structure and tools tailored for businesses. Specifically, Business+ subscribers benefit from a 0% platform fee rate on bookings – currently, platform fees on bookings for free business users are 8% (which as of now is the standard fee for all transactions; however, by subscribing you lock in this low rate even if standard rates change for others).
  • Business Premium ($49.99/month or $499.99/year): This includes all Business+ benefits plus additional perks. Premium users gain access to analytics dashboards (view metrics like profile views, booking conversion rates, customer demographics), and a Featured Business Profile status. "Featured" status involves your profile being highlighted or ranked prominently in search results, category pages, or in marketing materials. The intention is to increase your visibility to potential clients. Premium may also unlock advanced marketing tools as they become available.
  • Changes and Evolving Features: EquiLink is a startup and features can evolve. We reserve the right to modify the benefits of Business+ or Premium as we improve the service. We will inform subscribers of significant changes. (For example, if we later offer a tier with different transaction fees or new analytics tools, those would be communicated.)

Payment and Auto-Renewal

  • Subscriptions can be paid monthly or annually. Monthly plans bill every month on the same date as sign-up; annual plans bill once upfront for the year. All subscriptions auto-renew by default to avoid interruption of service. This means at the end of your billing period (the next month or the next year), we will charge your saved payment method for the next period.
  • If you subscribed via the Apple App Store or Google Play Store, the payment is handled by that store and will auto-renew per their system. You may manage or cancel the subscription through your device's account settings.
  • Updating Payment Method: You must keep a valid payment method on file. If a charge is declined, we'll notify you and may retry. If we cannot process payment, we may suspend your subscription benefits until payment is resolved. You still owe any past due amounts. EquiLink reserves the right to charge any other card you have on file with us (for example, a card you used for bookings) unless prohibited by law, to fulfill the subscription payment.

Cancellation of Subscription

  • You may cancel your Business+ or Premium plan at any time. Cancellation means your plan will not renew at the end of the current paid term. You will retain your subscription benefits until that term expires. For example, if you paid for a year and cancel after 3 months, you keep benefits for the remaining 9 months, then it ends and you won't be charged further.
  • We generally do not offer refunds for unused time once a period is paid. So if you cancel a monthly plan mid-month, you won't get a half-month refund; you simply won't be billed for next month. If you cancel an annual plan early, you won't receive a refund of the remaining months (except maybe in special cases as required by law). One exception is if you are in a jurisdiction with a mandatory cooling-off period for digital services (e.g., some EU customers have 14 days to change mind on subscriptions). In such case, if you are eligible and you cancel within that window, we will honor a refund for that initial purchase, provided you have not made significant use of the subscription features yet.
  • EquiLink may occasionally offer free trials or promotional discounts for subscriptions. The terms of those will be specified (e.g., "30-day free trial, then billing starts" – if you cancel before trial ends, you won't be charged; if not, you'll be charged and it auto-renews). Only one trial per business, unless stated otherwise.

Price Changes

  • We may adjust subscription prices in the future (for instance, if we add major features or our costs change). If we do, we will give you at least 30 days' notice via email or in-app notification. The new price would apply to the next billing cycle after the notice period. If you do not agree to the new price, you must cancel your subscription before the next charge; by not canceling, you accept the new rate.
  • Similarly, if we change the structure (say, merging Business+ and Premium, or adding another tier), we'll inform you of how your current plan maps to any new structure.

Downgrades and Upgrades

  • You can upgrade from Business+ to Premium at any time; the upgrade will usually be immediate with a prorated charge (for example, if halfway through your month, upgrading might charge a prorated difference or start a new cycle – details will be provided at upgrade).
  • Downgrading (Premium to Business+): If you're on annual Premium but want to go down to Business+, contact us – we may schedule it for end of term. On monthly, you could cancel Premium and re-subscribe to Business+ after current period. We handle these requests in a way to avoid double charging – reach out if unsure.
  • If your Premium lapses (due to non-payment or cancellation), your profile may lose Featured status and analytics access. But you retain a normal Business+ level if you continue that, or revert to free usage if you canceled entirely.

No Transfer: Subscription benefits apply only to your account/business. They are not transferable to another user or account. If you sell your business or change ownership, the subscription can continue under the account, but if the account ownership changes, let us know to update billing info, etc. Reselling subscriptions or "sharing" one subscription among multiple unrelated businesses is not allowed.

3. Platform Fees and Payouts

One of the core benefits of using EquiLink is handling bookings and payments seamlessly. As a Business User, here's what you need to know:

  • Platform Service Fee: For each booking or transaction made through EquiLink where you (the Business User) receive money, EquiLink charges a platform fee. This fee is a percentage of the transaction amount. Currently, the standard platform fee is 8% of the amount paid by the customer. For Business+ and Premium subscribers, the platform fee on your transactions is 0%. EquiLink reserves the right to adjust the standard platform fee in the future for subscribers and non-subscribers. If any fee changes occur, we will notify users.
  • The platform fee is how EquiLink earns revenue to maintain the marketplace (and cover payment processing, support, etc.). It is deducted from the payout to you. For example, if you charge a rider $100 for a service, with an 8% fee, EquiLink would keep $8 and you'd receive $92 (subject to any applicable payment processing fees, see below).
  • Payment Processing Fees: Note that payment processors (Stripe, credit card networks) charge their own fees (usually around 2.9% + 30¢ per transaction). In our model, these processing fees are generally absorbed within the platform fee or added on top – we will make it clear. Currently, our 8% platform fee includes basic processing fees on our end, meaning we (EquiLink) cover the Stripe fees out of the 8%. We do not additionally charge you for Stripe's fee. If that ever changes (e.g., a separate "plus processing"), we would inform you.
  • Pricing and Taxes: You as the business are responsible for setting the prices for your services or events in the EquiLink platform. Set your prices to include taxes or additional fees you need to cover, as appropriate. If you are required to charge VAT, sales tax, or any other tax, factor that into your listed price or clearly indicate how it will be added. EquiLink may implement features for tax handling, but ultimately you must comply with your local tax laws. EquiLink is not responsible for calculating or remitting your business taxes (except possibly where marketplace facilitator laws require us to handle certain taxes for events/ticketing – if applicable, we will let you know and handle it in the system).
  • Platform Fee Disclosure: We encourage transparency. It's fine to let customers know that a portion of the fee goes to the platform if you wish, but do not attempt to separately charge the customer the platform fee outside of EquiLink. (Example: Don't say "Price $100 + 8% EquiLink fee if paying through app." Just price it at $108 if you need to, or $100 and you take $92 net. Charging extra off-platform to avoid fees violates our terms.)

Payout Process (Stripe Connect)

  • EquiLink uses Stripe Connect Express to manage payouts to business users. This means when you sign up as a business and wish to accept payments, you will be prompted to create or connect a Stripe account through our platform. The Stripe flow will ask for required info: legal name, date of birth, business name, EIN or personal ID (for KYC/KYB), bank account details for deposits, etc., as mandated by financial regulations. You must provide accurate info and keep it updated. Stripe might also require additional verification documents (like an ID scan or business registration proof).
  • By using our platform to accept payments, you agree to Stripe's Connected Account Agreement and any relevant Stripe terms. Essentially, Stripe is the third-party facilitating the money movement.
  • Once you are set up, customer payments for your services/events/products will be processed via Stripe. EquiLink (via Stripe) acts as the limited payment collection agent on your behalf. That means when a customer pays through the app, it is as if they paid you directly, and you authorize EquiLink to collect those funds for you and then disburse them to you (minus fees). This structure ensures that once the customer has paid EquiLink, they have fulfilled their payment obligation to you, and you agree to deliver the services. You also agree that EquiLink/Stripe's confirmation of payout or payment to you is binding.

Payout Schedule

  • General Rule: Payouts are initiated through Stripe as soon as a transaction is successfully processed. The timing of when funds reach your bank account depends on Stripe's payout schedules, which may vary by country, bank, and account status.
  • One-Time Services, Events, and Digital Products: Funds are released immediately after the transaction is processed and confirmed. Stripe may apply standard settlement timelines (e.g. 2–7 business days depending on your bank and region).
  • Recurring Services: Payments for recurring services will follow a set schedule once you accept the booking:
    • Daily: Processed every Sunday at 3 AM UTC.
    • Weekly: Processed every Sunday at 3 AM UTC.
    • Monthly: Processed on the 1st of each month at 3 AM UTC.
  • Additional Notes: Stripe handles the transfer of funds from the EquiLink platform to your connected account. EquiLink may temporarily hold or delay payouts if there is suspected fraud, chargebacks, or unresolved disputes.
  • The exact timing also depends on Stripe's processes and any risk review. New Stripe accounts often have a short initial delay (e.g., first payout might take 7 days). After that, payouts might be daily or weekly. We will provide you info on the expected payout timing in your dashboard (e.g., "Next Payout: $500 on Oct 15").
  • If you cancel a booking or a refund is issued before payout, that amount won't be paid out. If you already received a payout and then a refund or chargeback happens, you agree to reimburse/return those funds (see Refunds and Chargebacks below).
  • Payout Method: Payouts go to the bank account or debit card you linked in Stripe. Ensure those details are correct. EquiLink is not liable for money going to the wrong account if you provided incorrect info. If a payout fails (e.g., wrong account number or closed account), Stripe will notify us and you; you'll need to correct the info and there may be a delay to reissue the payout.
  • Transaction Records: You will have access to a breakdown of transactions in your EquiLink dashboard (or Stripe's dashboard) showing gross amounts, fees, and net payouts. Keep these for your accounting. At year-end, if you are in the US, Stripe will issue a Form 1099-K for your earnings if you meet thresholds (which now is $600, meaning basically if you got any significant payout, you'll likely get one). You are responsible for reporting income to tax authorities.

4. Listing Your Services/Events/Products/Opportunities/Knowledge

Quality and honesty in listings are crucial:

  • Accurate Information: All content you put on your business profile or listings must be truthful and up-to-date. Do not advertise services you cannot provide or credentials you do not have. For example, if you claim to be a certified instructor or have insurance, you should actually have those credentials. If things change (you move locations, change prices, etc.), update your listings promptly.
  • Service Listings: When listing a service (like lessons, training sessions, boarding, farriery, etc.), clearly describe what is included, the duration, any prerequisites (e.g., "Riders must have their own helmet" or "For horses located within 30 miles of my location"), and the price. If the service is location-specific, provide the address or area you serve. Add high-quality images if possible (e.g., pictures of your facility or yourself at work) – but ensure you have rights to those images (no random Google images; use your own or licensed photos). Do not include contact info or attempts to take conversation off-platform in the listing; the platform will provide messaging once users connect.
  • Event Listings: When listing an event, provide all key details: date/time, venue/location, registration process, any limits (like "max 20 riders"), fees, deadlines, and your refund policy if different from EquiLink's standard (must be reasonable). If certain waivers or forms are required on-site, mention them. Essentially, someone should know exactly what to expect by reading your event listing.
  • Product Listings: When listing a product, include the product name, a clear description, the price, and a link to your own website or online store for purchase. Do not misrepresent the condition, shipping terms, or availability of the product. Use only images that you own or are licensed to use. Duplicate, misleading, or "placeholder" product listings are not allowed.
  • Knowledge Hub Listings: When publishing in the Knowledge Hub, whether it is a free resource or a paid digital product, describe what the content includes in clear terms (such as number of pages, format, or topics covered). Content must be practical, accurate, and relevant to equestrians. If the product is paid, the price should be listed clearly. You must own the rights to distribute the material or have permission to do so. Plagiarized, harmful, or misleading content will not be allowed.
  • Opportunity Listings: When posting an opportunity (such as sponsorships, collaborations, internships, or job placements), describe the offer in full, including the requirements and expectations. Make it clear whether the opportunity is paid, unpaid, or includes other benefits such as housing or lessons. If there are deadlines or timelines for applications, include them. Misleading or bait-and-switch opportunities are not permitted.
  • No Misleading Pricing: The price you list should be the price the user pays (aside from clearly explained extras). Don't bait-and-switch. For instance, listing a lesson as $50 and then later telling the user "actually it's $80 because of arena fees" is not allowed unless you disclosed that $30 arena fee clearly in the listing or pricing breakdown. Use the platform's pricing options (if we allow add-ons or fee line items) to be transparent.
  • No Circumventing Booking: Once you've listed on EquiLink, you should conduct booking and payment through EquiLink for those leads. Do not post a listing only to funnel people to pay you outside. That undermines the system and is a violation (as per Terms/Guidelines). We may monitor messages for attempts to share contact info or complete deals off-platform. Understand that consistently trying to avoid EquiLink fees could result in removal.
  • Compliance with Laws: Ensure your listing content comply with all applicable laws and regulations. For example, if you're organizing a competition, comply with relevant sports federation rules or liability laws (some places require certain disclaimers for equine activities – you may need to post those at your event; those are your responsibility). If you provide veterinary services, you must be licensed. EquiLink is not responsible for unlicensed practice – you must only offer services you are legally allowed to in your jurisdiction.
  • Third-Party Rights and Permissions: If your listing includes photos or content that depict third parties (people or property), make sure you have permission. For example, a photo of a student riding – get their or their guardian's okay to use that in your advertisement. Also, do not include someone else's trademark in a way that confuses users (e.g., don't name your profile "FEI Official Clinic" unless it truly is official; don't use another brand's logo without right).

5. Conduct and Service Fulfillment

As a business user, you are expected to deliver professional service:

  • Service Fulfillment: When a user books your service or buys a ticket to your event via EquiLink and you accept/confirm it, you are entering a contract to deliver that service/event as described. You must make good faith efforts to fulfill it. Cancelling should be a last resort. If you must cancel (due to emergency, weather, etc.), do so as early as possible and communicate with the client. Frequent last-minute cancellations or no-shows on your part can lead to poor reviews and potential suspension of your account.
  • Quality and Safety: You agree to perform your services with the appropriate level of skill, care, and professionalism. Adhere to safety standards – e.g., if you're giving lessons, enforce helmet use as required, check equipment, etc. If you run events, ensure the environment is safe and that you have any required permits/insurance. If you publish content or digital products in the Knowledge Hub, you agree to deliver the product as described. Content must be useful, relevant, and safe for equestrians. EquiLink's reputation is tied to user experiences, so we expect you to maintain high quality. We might introduce a rating system; maintaining a decent rating could be necessary to keep offering services.
  • Communication: Be responsive to messages and inquiries from users. EquiLink's messaging platform should be monitored (enable app notifications or check the site regularly). Prompt communication can prevent misunderstandings and improve your success.
  • Customer Data and Privacy: Through EquiLink, you may receive personal information of riders or attendees (name, contact info, perhaps health info if they provide it for events, etc.). You agree to use this information only for the purposes of fulfilling the service or event for which it was provided. Do not store it longer than necessary or use it for unrelated marketing unless you have separate consent. You must comply with privacy laws regarding personal data (for instance, if a user gives you their email via EquiLink for event updates, don't add it to your newsletter without permission). Protect any personal data you obtain – keep it confidential and secure. If a user deletes their EquiLink account or requests deletion, you should remove their data from your records that came via EquiLink, unless you have an independent reason to keep it (like a legal requirement).
  • Independence: You understand that using EquiLink doesn't make you an employee, agent, or representative of EquiLink. You are an independent business/contractor. You are solely responsible for your actions and the content you provide. EquiLink does not direct how you perform your services (aside from the policies herein), and we do not supply you with equipment, etc. As such, you carry your own risk and liability in providing the services. (Make sure you have appropriate insurance where relevant – e.g., liability insurance if you teach riding or host events. EquiLink currently does not provide insurance coverage for you.)
  • Interactions with Users: You agree to abide by the same Community Guidelines as everyone. That means no discrimination – serve clients in a fair manner. If you need to decline service for a valid reason (horse health requirements, safety concerns), communicate respectfully. Do not harass or argue with customers; if there's a dispute, try to resolve amicably or involve EquiLink support. Also, do not retaliate against a user for exercising their rights (like leaving an honest negative review). Retaliation or extortion (e.g., "I won't give you a refund unless you remove the bad review") is strictly forbidden and could result in losing access to the platform.

6. Refunds, Cancellations, and Disputes

You agree to EquiLink's Refund & Cancellation Policy (see separate document) as it applies to your services. Key points:

  • If a customer cancels within allowable time (per the policy or your stated terms) and is entitled to a refund, you will support that and understand you won't be paid for that booking (or will return the payout if already received).
  • If you cancel on a customer, you authorize EquiLink to refund them in full, and you won't receive payment. Frequent cancellations may affect your standing.
  • If a customer complains that a service was not delivered as promised, EquiLink may investigate. We strive to be fair: if evidence shows you did deliver substantially what was promised, we'll stand by you; if the service was severely lacking or not provided, we may issue a refund to the customer. You might then effectively not get paid or have to return the funds. This will be handled case by case, but by being on the platform, you accept that EquiLink's resolution decision is final (you can appeal, but ultimately we need to make a call to keep trust).
  • Chargebacks: In the event of a credit card chargeback by a customer, Stripe will notify us. You agree to assist in fighting any unjustified chargebacks (provide receipts, communications). If a chargeback occurs, the amount may be taken from your Stripe balance or future payouts. If we (or Stripe) determine the chargeback was due to your failure (like you didn't provide the service), you will be liable for that amount and any associated fee. If we successfully dispute a chargeback, we'll return the funds to you.
  • If a dispute arises between you and a user that you cannot resolve amicably, you can escalate to EquiLink support. We may mediate or propose a resolution. As a condition of using the platform, you agree to accept EquiLink's mediation decision, which will be based on our policies, evidence, and fairness.

7. Violations and Account Suspension

EquiLink has the right to suspend or terminate your business account for violations of this Agreement, the general Terms, or any of our policies. Grounds for suspension/termination include, but are not limited to:

  • Providing false information during signup or verification.
  • Consistently poor service, fraudulent activity, or high volume of complaints.
  • Engaging in prohibited conduct (harassment, discrimination, illegal stuff) with EquiLink users.
  • Attempting to circumvent the platform for payments or encouraging users to do so.
  • Misuse of subscription features (e.g., if any Premium feature is abused).
  • Non-payment of fees or subscriptions owed.
  • Activities that harm the platform's integrity or reputation.

If your account is suspended, we will typically provide notice and possibly a chance to appeal or correct issues, except in severe cases where immediate action is warranted.

If you are terminated:

  • You must cease using EquiLink's platform as a business and you lose any subscription benefits (no refund for the remainder of period if termination was for cause, i.e., due to your misconduct).
  • Any upcoming bookings you had may be canceled (with full refunds to customers).
  • We may hold any payouts for those or require refund of payouts for services not rendered.
  • You remain responsible for any obligations (e.g., fulfilling services that were already delivered, chargebacks on past transactions, etc.).

8. Payout Issues and Inactive Accounts

  • If we are unable to transfer funds to you because your provided bank info is incorrect or your Stripe account is unresponsive, we will try to contact you. If we cannot get correct info and funds remain undeliverable for 90 days, we may treat it as unclaimed property and handle according to laws (which might involve sending it to state authorities as unclaimed funds). So please keep your payout info updated to get your money!
  • If your account is inactive (no logins or responses) for an extended period (like a year), we may temporarily suspend listings to avoid customers booking something with a non-responsive provider. We'll notify you if so. You can always contact us to reactivate when you come back.

9. Intellectual Property and Marketing

  • Your IP: You retain ownership of your brand, logos, and content you provide. However, by using EquiLink, you grant us a license to use your business name, logos, and content (like listing photos) for the purpose of operating and promoting the Platform. For example, we might feature your profile in a "Top Trainers in California" article or on our social media, or crop your logo into a collage of partner businesses. This usage will be respectful and to drive more attention to your services. The license is worldwide, royalty-free, and for as long as you have an active profile (and a reasonable period thereafter for any continued promotional materials already in circulation).
  • EquiLink IP: You agree not to misuse EquiLink's intellectual property. The EquiLink name, logo, and code are ours. You won't copy our app or create derivative marketplaces from information gleaned here. You won't publicly disparage EquiLink using our logo without permission. (Constructive criticism or private feedback is okay, of course. This is more about branding usage and malicious remarks.)
  • Marketing Communications: We may reach out to you with service updates, promotional opportunities, newsletters, etc. as a business user. You can opt out of non-essential emails. But we might also send you important info like policy changes or booking notices which you shouldn't opt out of.
  • Third-Party Marketing: If you collaborate with a third-party via EquiLink (say you team up with a brand for an event listed on EquiLink), ensure compliance with all parties' terms. Don't, for instance, export EquiLink user emails to send to a brand's mailing list without user consent.

10. Liability and Indemnification

  • No Warranty: EquiLink provides the platform "as is". We make no guarantees that you will receive a certain number of leads or any business success by using EquiLink. We don't warrant that the platform will be uninterrupted or error-free, though we aim for reliability. As a provider, you assume the risks of running your business.
  • Your Liability: You are liable for your own acts and omissions and those of any people you employ or partner with in providing services (for example, if your assistant instructor causes harm, that's on you as far as the user is concerned). EquiLink is not responsible for the conduct of your employees or clients (though we may intervene on the platform to enforce rules).
  • EquiLink Liability: To the extent permitted by law, EquiLink's liability to you is limited. We are not responsible for indirect damages or lost profits. Our total liability is capped (as stated in the Terms of Service, usually to amount of fees we earned from you or a small fixed amount). We do not control offline interactions, so if an incident occurs at a barn or event, that is generally outside our control. That said, if something was clearly due to a platform error (like a bug double-booked you or mischarged someone), we will work with you to fix it, but formal liability remains limited as above.
  • Indemnification: You agree to indemnify and hold EquiLink (and its officers, directors, employees) harmless from any claims, lawsuits, or disputes arising out of: (a) your use of the platform, (b) your services or events (like any injuries, damages, or losses that occur during or as a result of them), (c) your breach of this Agreement or any law, or (d) your infringement of third-party rights. This means if someone sues EquiLink because of something you did (for instance, a client gets injured at your event and includes EquiLink in the lawsuit), you will cover our costs and damages to the extent that we were not negligent. We'll notify you of such claims and you'll cooperate in the defense. We can choose our legal counsel.
  • Insurance: EquiLink does not provide insurance for business users or their clients. We strongly encourage you to have your own liability insurance appropriate to your activities. Some events may require you to show proof of insurance or waivers – that's up to you to manage. EquiLink's platform does not currently integrate insurance offerings, but we may in future (we'd notify you of any optional programs like that).

11. Miscellaneous

  • Term of Agreement: This Agreement applies from the time you sign up as a business user until termination of your business account. Certain provisions (like payment obligations, indemnities, etc.) survive termination.
  • Relationship to Terms of Service: This Agreement is part of the overall Terms of Service that apply to all users. If there is a conflict between this Business Agreement and the general Terms of Service, this Agreement will govern matters specific to business users. In all other respects, the general Terms (including provisions on dispute resolution and governing law) also apply. For example, any disputes arising under this Agreement will be handled under the dispute resolution process and governing law set out in the main Terms (currently Canadian law).
  • Amendments: EquiLink may amend this Agreement by providing notice to you (e.g., email or in-app) at least 15 days before changes take effect, unless a change is required sooner by law. If you continue to use the platform or keep your listings active after the effective date, that constitutes acceptance of the new terms. If you do not agree, you must stop using the platform as a business (and ideally inform us to deactivate your business account). For material changes, we encourage you to reach out with any questions during the notice period.
  • Assignment: You cannot transfer this Agreement or your account to someone else without our consent. If you sell your business and want the new owner to take over the EquiLink profile, they'll need to register and agree anew (we can help transition the profile via support). EquiLink can transfer its rights and obligations to an affiliate or in a merger/acquisition scenario.
  • Severability: If any part of this Agreement is found invalid or unenforceable, the rest remains in effect.
  • No Waiver: If we don't enforce part of this Agreement at any time, it doesn't mean we waive the right to enforce it later.
  • Notices: Official notices to you will be sent via the email on file or via the Platform. Notices to us from you should be sent to our business contact (legal@equilink.com). Both parties agree to electronic communications for contractual purposes.

By clicking "I Agree" or activating a business profile, you acknowledge that you have read and understood this Business User Agreement and agree to be bound by it.
